The Immovable Property Commission (IPC) has resolved 1,840 applications to date, it was announced on Thursday.
Commenting on the current activities of the Commission, President Ersin Tatar pointed out that the Immovable Property Commission was an indispensable element of the property regime that is in accordance with international law.
“For the Immovable Property Commission to continue its work even more effectively, we will continue to provide all kinds of support and create the necessary resources, primarily from our government, with the backing of our motherland Türkiye, to whom we are always grateful,” Tatar said.
“As is known, the Immovable Property Commission, established under Law No. 67/2005, was recognized as an effective domestic legal remedy for property claims related to the properties left by Greek Cypriots in our country with the European Court of Human Rights’ Demopoulos decision in 2010,” the President said.
“To date, 1,840 applications submitted to the Commission have been concluded. Among the concluded applications, compensation was awarded in 1,161 cases, restitution was granted in 15 cases, exchange and compensation were ordered in 2 cases, and exchange was ordered in 1 case. Additionally, 10 applications were settled through the Immovable Property Commission under Law No. 13/2008,” Tatar noted.
“In 2024 alone, the Immovable Property Commission concluded 112 applications and made payments for nearly 200 compensation decisions. With the payments made so far, all applications decided by the end of 2020 have been fully paid, and payments will continue to be made at the same pace in the coming period,” he added.
“Under the ‘Xenides-Arestis Group,’ which is still under execution before the Council of Europe, even for one of the limited number of Greek Cypriot property cases that were ruled to have violations by the European Court of Human Rights before the Demopoulos decision, a Greek Cypriot applicant sought resolution before the Immovable Property Commission. The said application was recently concluded before the Immovable Property Commission, and the awarded compensation was paid a few days ago. This payment is the second-largest amount ever paid by the Immovable Property Commission” the President explained.
“This decision alone demonstrates that the Immovable Property Commission is an effective remedy concerning Greek Cypriot property claims. The Greek Cypriot applicant has also submitted a request for the termination of the supervision before the Committee of Ministers of the Council of Europe,” Tatar said.
“The Immovable Property Commission is an indispensable element of the property regime in the Turkish Republic of Northern Cyprus (TRNC) that complies with international law. The work carried out by the IPC, whose effectiveness has been acknowledged by the European Court of Human Rights (ECHR), creates a positive impact in the context of the execution of the court’s decisions,” he noted.
“To ensure that the IPC continues its work even more effectively, we will continue to provide all kinds of support and create the necessary resources, primarily from our government, with the constant support of our motherland, Türkiye, to whom we are always grateful,” President Tatar stressed.
