Reasoned decision in the İsias Hotel case announced.
Following the announcement of the reasoned decision in the İsias Hotel case, a press conference organized by the Champion Angels Memorial Association was held.
The reasoned decision was evaluated, and the steps to be taken for the appeal process were shared with the public.
Bar Association President Hasan Esendağlı stated that they would travel to Ankara shortly to begin technical preparations with their lawyers.
Esendağlı noted that the two-week appeal period had commenced and that the Court of Appeals for the case would be the Regional Court of Justice in Gaziantep.
Stressing that the Court of Appeals had extensive powers, including examining the case file, holding a new hearing, hearing witnesses, and accepting additional evidence or testimonies, Esendağlı also highlighted that the court had the authority to issue a new decision or amend the existing one.
He explained that once technical preparations are complete, the appeal petition would be filed, after which the court is expected to schedule a hearing date for the case.
Esendağlı further added that the duration of appeal proceedings depends on the workload of the regional court, but his colleagues estimate that the process should not exceed 8 to 10 months.
Stating that they were mobilizing all possible legal resources, he stressed that the path to appeal at the High Court of Appeal remained open.
The Undersecretary of the Prime Ministry’s State Planning Organization, Durali Güçlüsoy, highlighted that a new evaluation would be conducted with lawyers and families to plan the next steps and closely monitor the process.
Underlining that the ongoing fight, which began on February 6, aimed to prevent such tragedies and suffering in the face of potential future disasters, Güçlüsoy said, “That is why we call the İsias case our common cause, a precedent-setting case.”
He also noted that Prime Minister Ünal Üstel had repeatedly expressed his sensitivity regarding the matter, demonstrating moral support by attending court hearings alongside the families.
Stating that the trial process for public officials would also commence and that following the announcement of the reasoned decision, appeal proceedings would now begin, Güçlüsoy added that the Adıyaman Chief Public Prosecutor’s Office had already announced its intention to appeal the decision of the Adıyaman 3rd High Criminal Court.
Stressing the government’s continued commitment, he assured that Prime Minister Üstel would diligently follow the upcoming processes.
Güçlüsoy also noted that if necessary, additional expert reports would be obtained to contribute to the legal proceedings.
Speaking on behalf of the Champion Angels Memorial Association and the Justice for Guides Platform, Ruşen Yücesoylu Karakaya expressed that the reasoned decision in the İsias Hotel case further deepened their expectations for justice.
Describing the decision as only the beginning, Karakaya stated, “As families, we demand that the perpetrators be tried for probable intent. This disaster was not a ‘mistake’ but a murder that was clearly foreseen.”
She stated that the evidence, expert reports, and all the facts presented in court clearly demonstrate that this tragedy occurred as a result of deliberate actions.
Stressing that the legal system must acknowledge this reality to ensure justice and impose exemplary punishments on the perpetrators, she added, “This decision will not only honor the rights of the lives we lost but also serve as a precedent to prevent similar tragedies in the future.”
Ruşen Yücesoylu Karakaya reaffirmed their commitment to pursuing the case relentlessly, stating that they would continue their fight for justice across all platforms to reveal the truth.
“We will never turn back on the promise we made to our loved ones. Justice will only be achieved when the perpetrators receive the punishments they truly deserve,” she concluded.
